NOW: A federal judge ruled eight years of Trump's tax returns must be turned over to a grand jury.

Trump's immunity argument was "repugnant to the nation's governmental structure and constitutional values," the judge wrote.

Things are moving fast! The 2nd Circuit granted a temporary stay of the subpoena to Trump's accountant while the court takes up the case on an expedited basis.

In dismissing Trump's lawsuit challenging a grand jury subpoena for his tax returns, the judge relied on what's known as an "abstention" doctrine — generally, that fed judges can decline jurisdiction when asked to interfere with certain state proceedings buzzfeednews.com/article/zoetil…
This "abstention" doctrine is rooted in the idea that the federal government should show respect for state government functions, and pending state criminal investigations is one area where the feds are supposed to show deference to state interests
But in case the 2nd Circuit disagreed with abstaining, the judge *also* got into Trump's argument for presidential immunity — he wholly rejected it, and rejected the idea that DOJ's position re: not indicting a sitting president was persuasive here buzzfeednews.com/article/zoetil…
Update: NY DA Cy Vance's office has asked the 2nd Circuit to set a very speedy schedule in the fight over the grand jury subpoena for Trump's tax returns — briefing done by Thursday, arguments (if needed) on Friday.

Update: Unsurprisingly, Trump's lawyers do not agree with Cy Vance's proposed briefing schedule. They'd prefer to finish briefing by 10/18 (Vance pitched 10/10) and then arguments as soon as the court "deems practicable" (Vance asked for 10/11)

VanDyke is the ninth Trump judicial nominee to be rated "not qualified" by the ABA committee, and the third circuit court nominee to date. He's been nominated for one of the Nevada seats on the 9th Circuit (filling Judge Jay Bybee's seat now that Bybee is taking senior status)
A "not qualified" rating from the ABA committee that vets judicial nominees is rare, both historically and also for this administration — Rs have accused the ABA of bias, but the vast majority of Trump's nominees have been rated "well qualified" or "qualified"

A lot has happened since a federal judge in DC ordered DOJ to turn over Mueller grand jury materials to House Dems. The deadline was going to be today, but the DC Circuit temporarily put that on hold until it formally rules on DOJ's motion to stay pending the appeal
Before going to the DC Circuit, DOJ also asked the lower court judge to put her order on hold. The judge last night denied the request: ecf.dcd.uscourts.gov/cgi-bin/show_p…

This doesn't interfere with the DC Circuit's temp hold, but it gives Dems a boost as the circuit weighs the stay issue
Again, the lower court judge's order isn't binding on the DC Circuit, but this is her way of adding to the record and making the case for why no stay is warranted: "The serious infirmities in DOJ’s arguments have already been addressed at length," Chief Judge Beryl Howell wrote

Leon brings a uniquely relevant background — before becoming a judge in 2002, he advised Congress in multiple investigations involving presidents. He's also a former DOJer. He's a Republican by background, but he is definitely not always a predictable vote by that metric

First, impeachment proceedings will continue into election season because Trump has stonewalled. You cannot simultaneously stonewall an investigation and complain that it is taking too long. Any GOP complaint about impeachment during the election is a problem of Trump’s making.
If Trump would like impeachment wrapped up by Christmas as #MoscowMitch suggests, fine. Comply with the subpoenas. Turn over your tax returns, bank and other financial records, Mueller grand jury materials, FBI counterintelligence case files, etc., and let all witnesses testify.
