Here’s one example from last week’s opening statements in HJC:
DOJ in a footnote says it will go to SCOTUS if it loses in appellate court. If that happens, DOJ asks the DC Circuit to keep its stay in place "especially given the serious question whether McGahn’s testimony is even relevant to the now-passed articles of impeachment."

Good morning from federal court in DC, where former Trump campaign deputy Rick Gates is scheduled to be sentenced at 10 am and closing out one of the final chapters from the Mueller investigation.
Gates is entering the courthouse now with his attorney Tom Green.
Gates takes his seat at the defense table. He's sitting in the same seat that Roger Stone was in (and the same courtroom) during his conviction last month.

NEWS: DOJ just filed its opening 71-page brief to the US Court of Appeals in the fight with House Democrats over access to the Mueller grand jury materials. Link here: ow.ly/tNje50xpOSB
DOJ argues Judge Howell's opinion should be overturned for two reasons. First, they say her ruling "rests on the textually flawed and constitutionally problematic premise" that Congress is conducing "judicial proceedings" as understood by federal grand jury rules.
And second, DOJ says Howell failed to consider a well-established test requiring the House to demonstrate a real need for the grand jury materials.

Good morning from federal court. At 9:30 am the DC Circuit US Court of Appeals will hear arguments in the Mueller grand jury materials case. House Judiciary Democrats won in district court. This is DOJ’s appeal for an emergency stay. Story to come after it’s done.
DC Circuit Judges Judith Rogers (Clinton appointee), Judge Brett Griffith (Bush 43) and Judge Neomi Rao (Trump) will preside.

A note on #impeachment -

In a court of law, under non-presidential circumstances, impeachment is a tool litigation attorneys use to discredit the opposing side's witnesses at trial. When said witness takes the stand under oath attys. present evidence contrary to what the witness
claims. This weakens the other side's case by discrediting impeached witnesses's testimony. Once a witness has been impeached - by presentment of inconsistent testimony - the judge/jury can no longer use the impeached witnesses's testimony in reaching a verdict.
Simply put, they aren't trustworthy. In the case of Presidential impeachment that broad definition of impeachment applies, but the impeachment tool is used for a very different purpose. Under the Constitution, a sitting President cannot be tried in a court of law for anything.
