1. Admit I don't have much experience with #SCOTUS practice but can't explain what I'm seeing in docket other than to say that it appears to me something is wrong with the the notice of appeal in the @ManhattanDA case that is pending in SCOTUS. @maddow @Lawrence @MaddowBlog
2. This morning, SCOTUS asked for the record on appeal from the 2nd Cir. It popped up in the SDNY docket and I got a notice of it. Here is the request.
3. I tried to match the requests with the docket and it doesn't jive. There is a specific request for a docket number as follows:

Supreme Court Record Request as to [37] Corrected Notice of Appeal filed by Donald J. Trump, [36] Notice of Appeal, filed by Donald J. Trump.
4. I looked at the docket and I don't see it in the 2nd Cir. The notice of the writ of certiorari is at the 2nd Cir docket at no. 161. I don't know what's going on but I have been in appeals where the court spotted a defect in the notice of appeal and dismissed it. @neal_katyal
5. I'll put the district court and 2nd Cir dockets on my blog for anyone who wants to try to figure out what's going on. @tribelaw

#NevadaCaucus: During my 1971 draft physical, we went to a class room where we had to review a massive list of subversive groups. I saw recently where Bernie admitted membership in some of them.
2.One guy in my group checked the Socialist Workers box and in minutes after he handed in his form two men in suits came in and hauled him out of the room. Based on my investigation, that's likely how Bernie avoided the draft. Somebody should ask him.
3. If that comes out during the election because the press failed to the job of #VettingBernie, we will lose the White House, Senate and the House. That's why Trump and Putin want Bernie IMO. He's hiding his past from us but not from Putin and Trump.

1. We should call for full Cold War embargo of Russia for its continued attack on US. Any politician that supports Russia like @POTUS & @SenateGOP should be charged as traitors.
2. 48 hours to appoint an intelligence pro to @ODNIgov or @SpeakerPelosi should tee up another impeachment but this time make every 2020 @SenateGOP the target. Make the case they are working for our enemies. Make the American people hate the sight of them and want them in prison.

2. state's four congressional districts. The precinct caucuses also elect delegates to county conventions based on the results of the vote in each precinct. Of the remaining 13 pledged delegates, another 5 will be allocated to party leaders and elected officials (PLEO delegates)
3. in addition to 8 at-large pledged delegates, but it is not yet known whether delegates to the national convention will be distributed proportionally based on the popular vote in the caucuses or the number of county delegates."

1. With two of the subpoenas for @realDonaldTrump's financial records likely to make their way to #SCOTUS in the next 36 hours, I wanted to put together a detailed #thread walking through where we are and what happens next.

Apologies in advance, but this is going to get nerdy.
2. The first case is Trump v. Vance, arising out of a subpoena issued to Mazars by New York County (Manhattan) District Attorney Cyrus Vance. In that case, the President has asked the federal courts to issue an injunction barring Mazars from complying with a _state_ subpoena.
3. The district court refused to issue the requested injunction. Last Monday, the federal appeals court affirmed that decision, almost entirely because it concluded that President Trump did not have a substantial "likelihood of success on the merits."

1/ Belated thread on Virginia House of Delegates v. Bethune-Hill, which suddenly took on new relevance in light of 5th Circuit's ACA supplemental briefing order: #SCOTUS
2/ This case concerns whether a state legislature has "standing to appeal" *after* the district court issued a ruling. The newly-elected Democratic AG "would not pursue an appeal to" #SCOTUS However, the GOP-controlled House filed a notice of appeal.
3/ #SCOTUS held that the House "lacks authority to displace VA Attorney General as representative of the State" and "single chamber of a bicameral legislature, has no standing to appeal the invalidation of the redistricting plan separately from the State of which it is a part"

1/ J. Thomas, joined by Alito and Gorsuch, were still not done with Price v. Dunn (the Alabama death penalty case). Today #SCOTUS finally denied certiorari (a formality after the stay was denied). J. Thomas wrote a concurrence in the denial of cert "set the record straight"
2/ This dissent is unusually blunt for J. Thomas. He writes that "there is nothing of substance" to J. Breyer's assertions. He provides an "accurate recounting," suggesting that Breyer provided an "inaccurate recounting." (Though later Thomas says Breyer's facts had omissions)
3/ J. Thomas also shines light on precisely why the majority found that the appeal was untimely: "petitioner (like all other individuals) is presumed to be aware of the law and thus the June 30 deadline"

So here's a boring procedural take on these petitions while you enjoy your leftovers. /1
The government says that it needs certiorari before judgment because without it, review would not take place until October Term 2019. /2
But here's the thing: To secure review /this/ Term the petition will need to be fully briefed and submitted to the Court by mid-January. Currently, the briefs in oppositions are due on December 24, 2018. /3
