BREAKING: US District Judge Jesse Furman "vacates Secretary Ross's decision to add a citizenship question to the 2020 census questionnaire" in a 277-page ruling after trial.
(More after SCOTUS opinions.)
More on the Census ruling to come from @dominicholden, but, on the #SCOTUS issue — recall, the court is due to hear a case over the evidence to be used in the trial in February: buzzfeednews.com/article/chrisg… — it's not *exactly* clear what happens now.
Now would be a time for DOJ and the SG's Office to seek certiorari before judgment — a reason why using that effort in so many other cases when they lost below might be questioned.
DOJ could seek a stay of Furman's ruling and file a notice of appeal today. At the same time, lawyers in the SG's office could seek cert before judgment at SCOTUS—noting possibility of the justices delaying the evidence case so all of the issues on the case can be heard together.
At this point, though, it would still have to all be done on an expedited timetable in order to be heard and decided this term — and decided before the forms need to be printed.
DOJ reaction to Census ruling: Still reviewing but "disappointed."
