FISA order in regards to FBI measures in FISA cases.

Interesting reading...
It has now spawned 2 separate investigations into the Page FISA, but I suspect many will think nothing is happening... #ButNothingsHappening #FISA

Looks like the Foreign Intelligence Surveillance Court has decided to create a separate investigation into the FBI lawyer (allegedly Clinesmith) who falsified evidence for the FISA.
This looks at the process & errors & how to correct them not the intentional misconduct.
The FISC has also spun off another separate investigation into the government's "handling and disposition" of any spying conducted under the @carterwpage FISA.

Many will miss that these 2 issues have spun off new court inquiries & will assume nothing is happening...
Obviously the court is focused most heavily on the 'material omissions' that Carter Page was an operational contact for the CIA against the Russians from 2008-2013.
Likely later but the FBI may have only asked about his service in the Buryakov timeline...
Unlike 3 years of Dem denials, the FISC says the Steele Dossier was a primary source for much of the FISA application.
More importantly, that some in the FBI knew the Steele Dossier was garbage & hid that from the application & the court.
Also documents that information discrediting Steele & his motivations were left out. The DOJ notified the court in July 2018 of the evidence that Ohr said Steele was desperate to stop Trump's election.
The court is also pleased with FBI Director Wray's efforts to fix this mess. Note this is also a new presiding judge Boalsberg who replaced Judge Collyer after the OIG report.
Increasing requirements & focus on finding & reporting exculpatory evidence to the court. Instead of burying it or never looking in the first place.
But the court is not convinced it will prevent intentional misconduct in the processing of an application.
One positive Woods Procedure change, FBI must now swear & sign off that they have informed DOJ of all exculpatory information that they know. So they can't play stupid after the fact...
Again, the court thinks the changes will reduce errors & mistakes. It does not believe they will prevent intentional concealment of evidence...
Court notes that DOJ did not push FBI agents for sufficient detail to get to exculpatory evidence. Now going to make them sign their life away that they did their jobs...
Even recommending sending DOJ lawyers to the field to review the evidence & files.
Court is working with FBI to take away the HQ Special type of investigation in a FISA case...
And making them sign off that they have put forward all evidence that might undermine probable cause for the application.
These changes are important for accountability, going forward at least.
Agents sign off that the information in an application is accurate, now they have to sign off that they didn't leave anything out. So it is the whole truth, not just the truth that fits...
FBI will also be using the Page FISA as a bad example, developing it as a case study of every way you can possibly screw up a FISA application.
Destroys the it was not so bad argument...
Pushing for more accountability, review, performance evaluation & discipline for FBI personnel involved in FISA processes.
Court expects a briefing on disciplinary findings in the Page case when finished & prohibits any involved from FISA participation while pending discipline.
Court find FBI & DOJ are making progress, but not enough to resolve this matter fully. Court is expecting new updates & answers by 3/27/20 to questions related to the FISA process.
Implementation of new training requirements by May 4th with all FBI FISA involved personnel completing training by 7/3/20
By May 22nd, documentation of FBI FISA quality control processes & results showing that they are working...
The spelled out order that no DOJ or FBI under disciplinary or criminal investigation for their work on the Page or ANY other FISA applications be eligible to work on any application sent to the court.
Looks like we will be seeing much more in the future on these topics, but the FISC is allowing the disciplinary & criminal proceedings to continue.
