Geofence-based warrants are fucking terrifying from a privacy perspective.
Geofencing is done actively by intelligence agencies, police departments corporations all the time - they are creepy enough, but unless you refuse to carry a phone, hard to defend against technologically.

This kind of post-hoc fencing warrant is way creepier.
I've been worried about the normalization of this tech since police started using it to contact potential witnesses motherboard.vice.com/en_us/article/…
Quite frankly law enforcement should not have this ability for any reason. Gaining a list of people that were in a place at a given time without their consent is a gross violation of freedom of association and the right to be secure against unreasonable search or seizure.
As I said, it is hard to build defenses against active geofencing short of not turning on your phone - that is just how the phone system works - you connect to local towers, and deploying communal networks is expensive.

That data should be destroyed though.
It's not because we need better privacy preserving regulations here.

As for google having location data...don't let anyone have your location data if you can help it, turn it all off, shut it all down.
Imagine how this capability might be (and frankly, today, is) abused:

* Give me a list of everyone i this area where protests were last week
* Give me a list of everyone at this gay bar
* Give me a list of everyone who traveled to this known undocumented persons charity.
