NEWS: The federal district court in DC has just found @realDonaldTrump’s termination of #DACA unlawful. Here's what the decision means ↓ 1/
The court is ordering the #Trump administration to accept — for the first time since the #DACA rescission was announced in September — *new* applications from DACA-eligible immigrant youth, BUT NOT IMMEDIATELY. 2/
The court is giving the Trump administration 90 days to explain why they ended #DACA, which the administration has failed to do thus far. 3/
Practically, this means that for now the DACA application process remains open only to people who previously had #DACA and want to renew, as specified by previous orders from courts in California and New York. 4/
Important: USCIS is NOT accepting any applications from first-time applicants at this time. 5/
What remains clear is the need for Congress to enact a permanent solution to #ProtectDreamers and end the uncertainty governing the lives of immigrant youth, their families and communities. 6/6

I truly appreciate the non-political folks calling for a #DACA deal as a route out of the shutdown. It’s VITAL to understand that this admin actually wants that cover in a public convo to mask what they’re actually pushing which is gutting asylum & putting migrant kids in jail 1/
The Pres ended DACA in Sep of 2017, he did it in a passive way cuz DACA is remarkably successful & popular. And then hid behind injunctions of multiple circuit courts that kept some pieces of the program in tact. But in reality his DOJ tried to hop over that in the 5th circuit 2/
That effort to bypass circuits failed as the 5th circuit case is still at the district court level. So then they decided to jump over the 9th & petitioned to SCOTUS anyway (the 9th has since ruled, but there is no circuit court conflict) 3/

Federal Judge orders full restart of DACA program - The restart won’t be immediate. U.S. District Judge John Bates said the order would be delayed until Aug. 23 to allow the government to appeal. apple.news/ADbtC1iiDTMOLC…
In a 25-page opinion Friday, Bates, an appointee of former President George W. Bush, rejected the administration’s argument that the original decision to end DACA remained sound. #DACA
If Friday’s ruling goes into effect later this month, the administration will be required to accept new applications from people who meet DACA’s eligibility requirements.

The key to understanding these three answers is that the First Amendment only applies to the GOVERNMENT, not to private actors.

The 1A states that "CONGRESS shall make no law...abridging freedom of speech."

It also applies to state and local govts.
The 1A does not apply to private actors, and so they can ban speech that the gov't cannot.

So, a college student attending UC Berkeley has 1A speech rights b/c Berkeley is a state school.

But, a college student attending Harvard, a private school, does not.
