Pick any sensitive issue that may come before Kavanaugh and where his vote is seen as a potentially decisive: a woman's right to choose, the right to subpoena the president, the president's right to pardon himself, immigration issues, etc.
Kavanaugh follows a pattern.
First, he offers a canned answer designed to deflect concern and suggest that he will uphold precedent. (Roe v. Wade, U.S. v. Nixon, etc.). Then, he offers a subtle caveat that seeks to narrow the applicability of the decision.
Then, when pressed on what he might do in a current case he deflects and says judicial independence prohibits him from answering. Where there is no precedent, where he senses a sensitive area otherwise, he also says he can't comment because of some excuse.
These include an unwillingness to comment on current events, on recent history, on pending cases, on cases where someone else found a good excuse not to comment, etc. He is inconsistent in how he applies these rules (some decisions are right, on some he can't offer a view.)
His goal was to make the hearings as meaningless as possible on the issues in which the American public has the greatest interest...and right to know. Speaking of which, documents that might similarly shed light on his views have been systematically withheld.
Presumably, if the opinions of Kavanaugh were not controversial or they would be seen as comforting to the broad cross-section of American voters, they would not be withheld or hidden. We have to conclude he wants to hide his real intent behind a veil of dodges and deceptions.
This should be clear to Senators as they vote on his nomination. He has made it clear through his silence that he is a real threat to Roe v. Wade, that he has a view of presidential legal exposure that seems to place the president above the law, that his views are dangerous...
...to those with pre-existing conditions, to refugees, to minorities, to future victims of gun violence, to those who might be exploited by corporations, etc. Don't let your Senators hide behind his veil of deceptions. A vote for him is a vote to end years of American progress.
As a final point, it also seems clear that he has lied under oath in the past and that he may have willingly trafficked in stolen emails for political gain, that for all his car pool dad PR that he is not a man of principle but one of back-alley DC politics.
The Dems on the Judicial Comm. have done what they could w/in a rigged set of rules to bring these facts to light. Now voters must do what they can to send a message to Senators that we voting for Kavanaugh is unacceptable and will cost them our votes. Let them know. Do it now.
