Tomorrow is the First Monday in October. It’s the start of the new term of the Supreme Court of the United States. It’s the second term of the past three to open with only eight justices on the bench.
With Justice Anthony Kennedy’s retirement over the summe, this also will be the first term since October Term 1981 to open without a Reagan appointee sitting on the bench.
Retired Justice Sandra Day O’Connor, the first female justice, joined the court 10 days before the October Term 1981 began.
Five lawyers, including two from the Justice Department, are slated to argue in the two cases before the justices on Monday. All five are men.
Further info on that point: Six of the remaining 17 lawyers arguing in the first sitting — a total of 6 of 22 in this sitting — are women.
