Affirmative action for historically discriminated against minorities has already been upheld by the Supreme Court.
The key factual issue to be determined at trial is different: whether Asian Americans are unfairly treated compared with the white majority.

They don’t even have a valid Attorney General!
And they want to mess with Harvard?
Bottom line: affirmative action for historically discriminated against groups will be upheld, but anything resembling what Harvard did in the early 1900’s with respect to Jews (an informal quota under President Lowell) will not pass legal muster today. I don’t know the facts.
