Affirmative action for historically discriminated against minorities has already been upheld by the Supreme Court.
The key factual issue to be determined at trial is different: whether Asian Americans are unfairly treated compared with the white majority.

They don’t even have a valid Attorney General!
And they want to mess with Harvard?
Bottom line: affirmative action for historically discriminated against groups will be upheld, but anything resembling what Harvard did in the early 1900’s with respect to Jews (an informal quota under President Lowell) will not pass legal muster today. I don’t know the facts.

That’s the entire point of having the DC and NYC mayor and police chief maintain order. Keeping visitors and emoluments flowing into Trump properties is surely their top priority.

To avoid improper augmentation of official federal government communications functions during a shutdown when normal functions are suspended Twitter should suspend all Twitter accounts of all federal officials until the government reopens.
Start with @realdonaldtrump.
@realDonaldTrump When the government is open Twitter is just one of many means of communication, particularly in the Executive Branch. During a shutdown the Executive Branch —particularly POTUS — relies so heavily on Twitter that anti-augmentation statutes are a real issue.
@realDonaldTrump In a shutdown situation when normal functions are suspended, including communications, government officials with large Twitter following have an even greater disproportionate advantage than they normally do. The government— or what’s left of it — is being run via Twitter.

1 - This is a summary of the DACA order today that came down from Judge Hanen in the US District Court for the Southern District of Texas. Judge Hanen was the same judge who ruled against the DAPA program in 2016.
2 - It’s pretty clear that the judge largely bought the plaintiffs overall arguments regarding the legality of DACA. And he suggested they would likely win at trial in his courtroom. But they didn’t meet the test for a preliminary injunction.
3- This is critical because it now means DACA will likely remain in place until the Supreme Court ultimately decides the issue. That could be another year or more away. Here’s the link to the case - scribd.com/document/38749…

One fact we can take away from 2017: Capital punishment is on the way out in America. The year is about to come to an end, so let's take a look back at some of the major events that occurred in the world of anti-death penalty work over the past 12 months. Thread:
An execution was scheduled for early January 2017 in Washington State. Governor Jay Inslee granted a reprieve and said he would do so in any similar situations in the future. The governor had announced a moratorium on executions in Washington back in 2014.
The new district attorney for Denver, Beth McCann, was sworn into office on January 10, 2017. District Attorney McCann pledged that her office would never seek the death penalty in any case.
