Per statement this morning, McConnell is moving ahead towards a vote on one of Trump's most controversial judicial nominees to date, Thomas Farr. This is going to force a showdown with Sen. Flake, who has vowed not to vote for nominees until a Mueller bill is brought to the floor

Sen. Flake has voted no on cloture for Thomas Farr, which will make for a 50-50 vote assuming all other Republicans vote yes and all Democrats/Independents vote no. VP Pence would need to break the tie
Republican Sen. Tim Scott is the only member who hasn't voted yet on cloture for Thomas Farr. It's at 49 yeses and 50 nos. You may recall that Scott broke ranks on Ryan Bounds's 9th Circuit nomination, which ended it buzzfeednews.com/article/zoetil…
And there it is: Scott votes yes on moving forward with Thomas Farr's nomination, which means there's a tie (50-50), which VP Pence can break
Voila: VP Pence breaks the tie, which means that Thomas Farr's nomination to the US District Court for the Eastern District of North Carolina can move to a final vote

This isn't over — a final vote on Farr is now on track for tomorrow. Flake is expected to be a "no" unless McConnell allows a vote on a Mueller protection bill
