A call for the revocation of the Article 50 notification. I have been on this, in various twitter exchanges, since the CJEU decision last week. I know it is not (really) on the political radar at the moment; but still. legalresearch.blogs.bris.ac.uk/2018/12/a-call… 1/
Given the judgment, the clear signal that the EU is not prepared to renegotiate the WA, and the ticking clock, I think that revocation is best, not only for remainers, but also for all Brexiters who oppose the WA and no deal. 2/
All the blame can, and should, be laid at the Government's door. It has failed to deliver a Brexit which commands sufficient support in Parliament and in the country. It has not articulated, or sold, a vision for Brexit. 3/
It has not levelled with the public about the nature of the hard choices which Brexit entails. It has shown contempt for Parliament. It has failed. 4/
Neither the WA, nor no deal, are acceptable Brexit outcomes. Parliament should not feel under any obligation to make a choice between them. Instead, it can revoke the notice. 5/
That enables the UK to reconsider (with thanks to @EuropeanRover). Various parties and factions can articulate their visions of Brexit (Norway plus, a jobs first Brexit, Canada etc). If there is a vision which commands sufficient support, A50 can be triggered again. 6/
It is not, I hope, unrealistic, to think that the UK might have learned some lessons from 2016. It is not enough to offer an 'abstract' leave option. It is important to listen to the concerns of the EU. Planning matters. 7/
My view is that it is unlikely that sufficient people would rally behind Brexit. Far more important to begin to fix relations with other States, and take steps to mend the divided UK. But I may be wrong. 8/
The Court's judgment makes it clear that the option to revoke again is there. It is a State's sovereign choice whether to be in or out of the EU. With the passage of time, a State's intention may change. 9/
This route provides an end to current uncertainty, and gives those opposed to the WA the time to articulate, sell and negotiate a better alternative. I can't see any other route through which that can occur. 10/10
