1. The legal rationale for finding the #ACA unconstitutional is sound. It was unconstitutional before SCOTUS Roberts’ patch job, and it’s even more unconstitutional afterward.
2. The law was always a patchwork mess, regardless of how noble it’s goals. That’s why your premiums have skyrocketed, and that’s why it’s unconstitutional.
3. Yes, of course it’s Congress’s job to make laws, not the courts’. This judge didn’t make law—he properly identified bad law. Now it’s Congress’s job to fix it.
4. This highlights what a terrible, botched job the 115th Congress was under Republican control. Historians will look back in amazement that Republicans could t deliver on their biggest political goal and #1 campaign promise of replacing Obamacare.
5. The #ACA will have to be patched by a future Congress, maybe the 116th but probably the 117th, with little likelihood of repeat of Republican control.
