Criminal prosecution of Cambridge Analytica (SCL Elections Ltd) begins in UK tomorrow. It’s a crime to defy an order from the Information Commissioner’s Office. They refuse to disclose a complete US voter file despite a legal order from their regulator. ico.org.uk/media/action-w…
Meanwhile in the USA, our closest counterpart is the FTC and it is shutdown. Its Facebook Cambridge Analytica investigation is delayed. The FTC vs D-Link trial is now also delayed to the summer. #ShutdownStories
For the record, I won’t be attending the trial tomorrow, but I will share news as it comes in. I’m not the plaintiff/complainant here. This is the ICO vs SCL, the UK regulator simply upholding the Data Protection Act of 1998. Not sure if we’ll see Nix or Wheatland cross-examined.
I have heard that the defendant, SCL Elections (Cambridge Analytica) switched their intent to plead not guilty to GUILTY. Judge is now deliberating.
Here is the guilty plea. Note they don’t admit to being guilty of data misuse, only for defying the authorities by failing to do anything about their orders to answer our legitimate questions. Next High Court date to watch for is March 18. More to come!
As I’m learning, the victim surcharge goes into a public fund. So at £21,170 per voter with about 200M registered voters in USA that’s around £4,234,000,000,000 ($5.4 trillion) in maximum theoretical criminal penalties if all US voters had filed an ICO complaint like me in 2017.
