Because this is an appallingly poor article, and it's clear you haven't done the slightest bit of legal research to justify your arguments.
Some basic reading and research would make clear the lawyers who are advocating for a national emergency declaration

Are advocating that the President act WITHIN his statutory authority.

There is no constitutional issue here.

As for political strategy, this is a remarkably novel approach.

"Sure, the President could use his lawful authority - delegated to him by Congress - but doing so would really be losing!"

Worse as a political matter, worse as a matter of good governance

Does a month-long shutdown set a better precedent?
Everyone’s like “using lawfully granted emergency powers would abuse our constitution!!!”

No more an “abuse” than using veto power to freeze the entire government

I've been writing a lot about the lawfulness of declaring a National Emergency to build the wall.

Now, let's talk about why it's the right political strategy - EVEN IF it would probably be held up by the courts and even if the GOP's Washington Generals disagree.
Here, @benshapiro attempts to lay out the problem in a simple, concise manner.

The problem? He's asking the wrong question(s).

The question for the GOP should be: are we more likely to get the wall if an NE is declared, or not?

He argues that declaring a national emergency is *probably* not legal and that the NE move *probably* won't work because the courts will throttle it.

I've explained why I think both of these conclusions are wrong. But even if he were right - it still makes sense to go for it!

Apparently, those lawyers who think there is clear statutory authority to reprogram funds to build the wall - like me, @Barnes_Law, @marklevinshow, and @jeastman714 - are "manufactur[ing] deceptive dreck" to "abuse and debase our constitutional system of government."
Let's just settle down.

Even the moderate, generally anti-Trump @lawfareblog concedes that pro-Wall commentators are advocating for executive action *within the statutory framework provided by Congress."

This is not about Article II. It's pure statutory interpretation.

A: 100 people die and 200 are injured each day across the US. Most deaths (~2/3) are suicide; these are mostly white middle-aged men from rural areas.
Approximately 30% are homicides: mostly young minority men from inner cities. The rest are accidental and mass shootings.

#DomesticViolence deaths from firearm injury are estimated at ~50/month.

And firearm injury is the 2nd leading cause of death for American youth.
