So there are a lot of people saying that NY did not pass a law that allows a woman to have an abortion up to just prior to birth.

Here are the FACTS- Directly from the LAW- Directly from the NY Senate Website.

I will explain each component with screenshots.

Section 4164 of the public health law is REPEALED.
Subdivision 8 of section 6811 of the education law is REPEALED.
This means that any licensed 'healthcare provider' can perform the abortion without a doctor present- as was the law before.

Sections 125.40, 125.45, 125.50, 125.55 and 125.60 of the penal law are REPEALED. These sections are where they take out ALL language pertaining to abortion. I will break down each subsection for digestion.

125.40 Repeal- Removes the liability of the 'healthcare provider' for performing an abortion that is not 'medically required'. Repeal means that that is no longer a law.

125.45 Repeal- Removes the liability of the 'healthcare provider' for performing an abortion that is not medically required on a female that is more than 24 weeks into her pregnancy. Hence opening the door up to the point of birth for an abortion to be legally performed.

125.50 Repeal- Removes the liability of the MOTHER (female) for committing or submitting to an abortional act upon herself. (Coat hanger?) Repeal means self-abortion is no longer considered criminal.

125.55 Repeal- Removes the liability of the MOTHER (female) for committing or submitting to an abortional act upon herself after the 24th week of pregnancy. Meaning the mother can self-abort up to the point of birth without criminality.

125.60 Repeal- Makes it legal to sell or issue abortional instruments and/or drugs with the intent of causing an abortion or miscarriage. This section had to be repealed because it is no longer illegal to self-abort. So essentially ANYONE can provide the abortion instruments.

So as you read through all of this you can see that ALL regulation of abortion has been removed from NY State law. It is now only a homicide if the baby is born and then falls under the state definition of 'Person' as outlined in the attached photo.

125.05 Repeal of subdivisions 2 & 3 are outlined in the photo below. Basically this is the COMPLETE removal of the word abortion from the NY State Penal Code. Any licensed 'healthcare provider' or self-abortion is legal up to birth. It is not a 'person' until born and alive.

125.15 Repeal- Good news ladies! If you have a 'medical' abortion or self-abort, NO ONE will be held criminally liable for your death during said procedure. If you DIE it is NOT manslaughter- it's just..... OOPS.

125.20 Repeal- Continuing the good news for women's rights- this also applies for all abortion procedures post 24th week of pregnancy. So there are the FACTS. Do you still think that this is a big step in the right direction for women's rights?
