and the Monday shitstorm continues. #DHS has posted a memorandum detailing the #ReturntoMexico process (#MPP) and its is absolutely atrocious. I had to take a baby aspirin while reading it. If you have the stomach... here we go. ..
1. assessment of 'most likely than not' persecution/torture will be made by asylum officers during either primary or secondary inspection. Why? so to deny right to counsel. *Yes. you got it right no counsel will be allowed during MPP assessments.
2. asylum officers could conduct #MPP assessments in person or remotely. Expect bulk via tel or video, which is awful and will undermine the best of claims. It sounds like it will be a total pro forma efforts just to be able to sneak it by courts. expect astronomical denial rate.
3. then there is this "supervisory asylum officer review" of all #MPP assessments bit which is laughable. The sup could "change or concur" in the initial determination. Sounds like a 'belt-and-suspenders' approach to make sure that no approval is ever granted.
4. then the #MPP assessment is turned back to CBP that decides if the process will go under sec 235b or 240 and if 240 proceedings are initiated, CBP will decide I'd #returntomexico will follow.
5. oh but wait, alphabet soup of immigration bureaucracy does not stop there. ICE can throw their hat in the ring to make "discretionary custody determination" for ppl subject to detention during 240 removal proceedings. Translation: will keep the private-jail bed quota at pick.
6. even if one manages to secure a precious favorable #MPP assessment, memo is clear this is not a grant of withholding. WHAT THE FUCK IS IT then: more likely than not that one faces persecution or torture????
