EU Brexit law
Member States agree positions on two proposed no deal laws - must still be agreed with European Parliament

Both laws would be unilateral and apply for a limited period.

1/ Preview of a CJEU judgment due tomorrow, on the European Arrest Warrant, detention & human rights - with a Brexit angle.

It concerns a UK citizen in Spain, wanted to face trial on drug charges in the UK. He's arrested in the Netherlands. Perhaps he was admiring the Van Goghs.
2/ The proceedings are delayed because the Irish courts have asked the CJEU whether European Arrest Warrants issued by the UK are still valid in light of the Brexit process. This brings TC's detention past the 90 day time limit under national law.
3/ The issue is whether keeping TC in detention afterward is still legal. On the one hand, the CJEU has said that longer periods of detention may be necessary to enforce a EAW: curia.europa.eu/juris/document…
On the other hand, the ECHR/Charter require that laws on detention be precise.

I think this saga has hit a nerve because it brings together every Brexit element in concentrated form:
- Lying MP, won't admit lie or engage
- truly appalling journalism from @ShropshireStar (conversely kudos to @alexisconran)
- shrieking ignorant jingoism of @DKShrewsbury

European Commission's #Brexit no deal contingency plans:
1. No visas requirement for visiting Britons (dependent on UK allowing visa free travel for short-stay EU citizens.
2. UK driving licences not automatically recognised. British wanting to drive on continent will have to check with individual countries.
3. UK nationals no longer permitted to use the priority EU/EEC priority queue (ie will have to go through 'Other Passports'.

1. The ERG have proven adept at making noise but they don't seem to be able to grasp policy. They get shot down every time they put their heads above the parapet and they have not been able to produce a credible alternative to chequers. #Brexit thread...
2. With philandering Johnson having blown his window of opportunity and the ERG seemingly backing down it looks like May will survive until Brexit day. That, though, does not change the fact that Chequers is a non-starter.
3. So given that member states are not prepared for a no deal Brexit any more than we are the Eu will want to buy time so will agree to a much more vague political statement on trade just to get the withdrawal agreement in the bag. That will still require an NI backstop.

1. The impossibility of meaningful treaty reform. We cannot edit the supranationalist DNA of the EU
2. The exclusion of the public from decisions relating to further integration. See Treaty of Lisbon.
3. The way in which the EU will seek homogenisation and integration for its own sake and for that of EU ideology over practical necessity.

Two EU sources say UK discreetly asked about extending #Brexit transition beyond Dec 31 2020. The EU said 'no'.

The EU offer of transition to Dec 31 2020 is plainly inadequate - just 21 months. The date is picked because it is the end of their budget cycle. Both sides know this. /2
The UK position - per Mrs May in Florence - is "about two years"

If the UK wanted transition to Dec 31 2021, that would be two years, nine months. Also inadequate. /3
