Worth noting: Page 2 of the EUCO draft conclusions warns there can be "no opening of the WA... Any unilateral commitment, statement or other act should be compatible with the letter and spirit of the WA."
I'm told this is a direct reference to Theresa May's letter to Tusk in which she signals her intention to "bring forward further domestic proposals that confirm my previous commitment to protect our internal market given the concerns expressed about the backstop."
In other words, the European Council draft warns May that any promises to the DUP must not undercut the backstop.

Some thoughts on #EUCO deal:

1/
Rightly, lots of comment last night about how clever the proposed mechanism is. Protects EU interests, while still keeping screws on UK to decide what to do

2/
But also worth noting that EUCO came up with deal at all. Much expectation (not least by me) that they'd kick it into next week, due to lack of prep time

So why didn't this happen?

NEW: updated draft conclusions: 'EUCO agrees to an extension to 22 May, provided WA is approved by the HoC next week. If the WA is not approved by the HoC next week, EUCO agrees to an extension until 12 April, expects UK to indicate a way forward for the consideration of EUCO'
The wording in the conclusions is very clever. I am told it was driven by France & Germany.
A senior EU official tells me that on the basis of what has been decided, "in agreement with PM May":

- either WA approved by UK MPs next week, then orderly Brexit on 22 May

or

- 12 April disorderly Brexit, or request for another extension

that @theresa_may is being ordered not to promise any concession to Northern Ireland’s DUP that impairs the impact in any meaningful way of the backstop loathed by DUP and Tory ERG MPs. EU leaders are not making it any easier for her to win that crucial meaningful vote. In...
the words of one well-placed source here in Brussels, they know her deal is already dead.

NEW: #EUCO Brexit draft conclusions state: ‘The European Council commits to agreeing to an extension until *22 May 2019*, provided the WA is approved by the HoC next week. Given that The UK does not intend to hold elections to the EP, no extension is possible beyond that date'
The conclusions will also 'approve the instrument relating to the WA and the joint statement supplementing the PD agreed between the European Commission and the UK in Strasbourg on 11 March 2019'
The leaders will also "take note" of Theresa May's letter.

Two parts done: joint interpretative instrument, new legal assurances on arbitration/best endeavours added to withdrawal agreement/lodged with UN And addition to the political declaration
Outstanding is a "unilateral UK statement"
Unilateral statement is a government recommendation to MPs that it has assurances it needs for meaningful vote #2. To form basis of new legal advice from attorney general. Not negotiated with EU but needs to be given green light
Expecting May statement at 11pm (10pm UK). If it's a deal all to be published for 11.30pm (10.30 UK)
