Important to note that this was a 2-1 decision — as in, there was a dissent — that came from a now-rare liberal-majority 6th Circuit panel.
This is how the dissent characterizes the judge’s actions that were so wild that Tennessee(!) quickly outlawed them: “Being offered contraceptive services, even being encouraged to accept free contraceptive services, is not an injury in fact for purposes of standing.”
That dissent is from Senior Judge Suhrheinrich, who was born in 1936, appointed to the district court by Reagan in 1984, and appointed to the 6th Circuit by George HW Bush in 1990.
