3rd Circuit ruled today that a requirement in Delaware's Constitution that candidates for the state's Supreme Court, Superior Court, and Chancery Court have to be Democrats or Republicans violates the First Amendment (of the US Constitution, that is) www2.ca3.uscourts.gov/opinarch/18104…
In a concurring opinion from Judge McKee (and joined by the other two members of the panel), he goes out of his way to say this is not a criticism of judges serving in Delaware's courts now, but about the potential damage of having judgeships contingent on political affiliation
Oh! As @gabrielmalor points out, the 3rd Circuit actually first issued this opinion in February, but it looks like they granted a petition for rehearing and then issued the new version today (reaching the same conclusion)

Under court rules, lawyers aren't supposed to make public statements about a case if there's a "reasonable likelihood that such dissemination will interfere with a fair trial or otherwise prejudice the due administration of justice" — this is the rule that allows for gag orders

House Rs in April 2016 appealed to continue the fight over what info DOJ could assert executive privilege over re: the Operation Fast and Furious scandal. Briefs were filed, but in Jan. 2017 the House asked for a delay, citing settlement talks and the presidential transition
In March 2018, DOJ announced a tentative settlement, but it hinged on the judge, Judge Amy Berman Jackson (you may remember her from such cases as US v. Manafort and US v. Stone), vacating her earlier rulings. Jackson said no (really more of a hell no): assets.documentcloud.org/documents/5029…

This is the same problem with the USPS. What is needed are FORENSIC AUDITS of all government run agencies. Let’s throw the Public School System in there. The VA & others always get the funding they ask for; the questions are in those budgetary line items that go “unspecified.” Or

Starting with her soft stance on #ISIS. In 2016, @IlhanMN asked for leniency in the sentencing of 9 Minnesota men who attempted to join ISIS, the terrorist organization famous for filming beheadings, owning sex slaves, and trying to destroy the West. - fox9.com/news/minnesota… (2)
According to @IlhanMN, lenient sentencing would somehow create less of an incentive for future recruits to join ISIS -- which is absolutely naïve, outrageous, and lacks evidence. (3).

Today is the 10th anniversary of the Americans with Disabilities Act Amendments Act, which reinstated Congress’ inclusive definition of disability after the Supreme Court narrowed the definition—Democrats and Republicans coming together to benefit over 61 million Americans!
Ten years ago, Congress needed to act to preserve the definition of disability; bi-partisan efforts with the disability and business communities resulted in the Americans with Disabilities Act Amendments Act.
A great example of Democrats and Republicans protecting the civil rights of over 61 million Americans.
