Federal prosecutors on Friday declined to make public transcripts of recorded conversations between Mike Flynn and Russia’s Ambassador Kislyak in December 2016, despite Judge Sullivan's order. Prosecutors did not provide an explanation for their refusal.

1. This is not a good development. Prosecutors better have a convincing reason to offer the judge regarding why they are declining to comply with the judge’s order to make public certain matters in the Flynn case. I’m the first to admit that Judge Sullivan’s order is unusual...
2. However, prosecutors refuse to comply with court orders at their peril. Unless there is a sealed filing in the case that further explains the prosecutor’s decision to decline to comply with the court order, I anticipate Judge Sullivan might issue a “Show Cause” order . . .
3. Directing the prosecutors to demonstrate why they should not be held in contempt for failing to comply with a court order. We’re not there yet, but this is the kind of thing that could ripen into a true constitutional crisis. Potential danger ahead . . .

Judge Sullivan ordered Mueller's team to produce discovery of government held exculpatory evidence. This would not be limited to information held by FBI & DOJ but also should include known information from DIA? courthousenews.com/judge-tells-mu…
People typically think of it as applying to evidence held by the prosecutors & law enforcement officers. But precedent, & the Sullivan order says Mueller has a duty to learn of exculpatory evidence "known to others acting on the government's behalf". Clearly the DIA is doing that
I'd also argue that the Senate Judiciary Committing is acting on the government's behalf, so information known to that committee would also be required production from Mueller to Judge Sullivan. Which brings us to an old piece of information that relevant to the @GenFlynn case.

1. A great find by @tracybeanz in the George Papad.apoulos case. Seems that the Mueller Special Counsel team has filed a motion with the court to seal discovery & impose restrictions on what Pdop's defense team can reveal from discovery provided by the DOJ & FBI.
@tracybeanz 2. There a few issues with this that are very telling. For the uninitiated, Discovery is the process where the prosecution & law enforcement are required to hand over any exculpatory evidence that may show the defendant is not guilty of the crime.

@tracybeanz 3. The first problem is that #papadopoulos has already plead guilty to the crime. SO this case should be heading toward sentencing but must now be going backward if the Special Counsel is handing over evidence that may show he is not guilty.
