1/ Why is AG Barr transferring responsibility for the census cases to the DOJ Consumer Protection Branch, given that its functions have nothing to do with the census? Watch for the name David Morrell, recently appointed to be Deputy Assistant AAG in charge of the CP Branch.
2/ Morrell clerked for Edith Jones and Clarence Thomas--then worked at Jones Day and in the White House Counsel's Office. No surprise he'd be in charge. Watch for whether any career lawyers agree to join, and whether OSG is on-board, despite its earlier representations re: 06/30.

2/ ... and even promised Nielsen he'd pardon her in order to encourage her to do so.

(ii) None of the more sane officials who've been forced out--from Kelly and Nielsen on down--are willing to now publicly call out the President and Miller for what they are.
3/ They remain complicit, even after they were ridiculed, overrun and effectively forced to resign (or in some cases removed). When they served, they could at least say (or tell themselves) that their involvement prevented things from being worse. What's their excuse now?

Even if we're fortunate enough to avoid the worst, even if we rid ourselves of Trump in 18 months, the nation is hopelessly broken--rent in two for as far as we can envision. I hope I'm wrong, but I'd very surprised if we the living ever again know hope, or come together as one.
To be clear: That's no reason to stop working--the difference between the worst and the merely horrible (two nations inexorably at odds) is extraordinarily important for vast #s of lives.

1/ Four notes about the SG's new emergency motion to SCOTUS for a stay of the district court injunction against building "Wall."

2/ First, notice how, on p.5 and 35-36, the SG defends the request for a stay by invoking a looming deadline for funding (supposedly 09/30), as in the census case. This time, however, the SG himself doesn't represent to the SCOTUS that that's a real deadline . . . .
3/ Instead, he says only that "According to DOD" ("DOD states," etc.) the $$ will expire. Hence, in the end he represents only that "if the injunction remains
in place, it *may* foreclose DoD’s ability to obligate the funds" and "*may* effectively operate as a final judgment."

There are 3 census cases. 11 DOJ lawyers who worked on them have asked to withdraw. That's after a trial in NY, appeals in NY & Md., hours of work research, work on issues & drafting pleadings. The new team from a DOJ division that doesn't do this kind of work.
James Burnham, a deputy assistant AG in the Civil Division's federal programs division, formerly from the consumer protection branch, where the new team comes from, reportedly told Barr a number of people who had been litigating the case preferred not to continue.

#REDFLAG: After a setback in the Supreme Court, Trump asks his lawyers if he can DELAY THE CENSUS

The census is constitutionally-mandated to begin in April 2020, under Article I, Section 2.

Trump is asking if he can IGNORE the Constitution b/c he doesn't like a SCOTUS decision.
#RELATED: The Supreme Court ruled against the Trump Administration's proposal to add a citizenship question to the 2020 Census...for now.

It would've led to a severe undercount, which would've rigged elections and resources in favor of white Republicans.
#HUGEWIN: The Trump Administration will begin printing the 2020 Census WITHOUT the citizenship question.

After missing their deadline, some feared Trump may actually try to defy the Constitution and the law.

This is an incredible victory for democracy!

Let's be clear here, this is what is going on with Barr.
1. As a matter of law, Barr cannot provide Congress with the grand jury information that Democrats just held him in contempt for not turning over to them.
2. Barr can, however, petition the courts to allow release, and the House Democrats have requested he do so. He refused, and this adds to their reasons for the contempt vote. Important to note, he is not required by law to accommodate their request to petition the court.
3. Democrats additionally feel his no-show for their hearing last week adds to their contempt charge. However, they had demanded, against normal order, that he be questioned by two prosecutors. Je did not agree but offered to teach an amicable arrangement.

Move over Sarah. AG Barr is the White House spokesman now. He said no one in the Trump campaign colluded with Russia. Flatly false! He said Trump fully cooperated w/ Mueller & was just “frustrated.” Trump’s undermined the investigation & smeared investigators daily. What a sham!
