I’ll be talking about Justice Stevens, what it was like to argue before him, and his legacy, on @Lawrence tonight at 1045 tonight on @MSNBC
I argued over 2 dozen cases before him. He was unbelievable. Brilliant. Polite. Committed to the truth.
My very first argument, Hamdan v Rumsfeld, was one of his most significant. He said the Guantanamo military tribunals were unconstitutional. He served in our Navy, and intuitively understood that America had the most to lose when the Geneva Conventions were abandoned.
Whether I was representing a corporation or a criminal defendant, I was always psyched Justice Stevens was there. He was a model Justice.
The only bright spot in this sad moment is that his legacy will live on. Justice Kagan replaced him eight years ago on the Supreme Court. She is a fitting replacement. END
