So @BorisJohnson’s kipper story turns out to be cobblers.
@EU_Commission confirms that it’s UK not EU rules that determine how the kipper is transported:
“The case described by Mr Johnson falls outside the scope of the EU legislation and it's purely a UK national competence.'
One thing I am still getting to the bottom of is - the Isle of Man isn’t in the UK. So maybe the kipper is subject to Manx rules.
Can you clarify @IOMGovernment?
Either way, it’s not Brussels to blame.

I spoke to @AgataGostynska who is a senior research fellow at the @CER_EU
I spoke to @ph_lamberts who is a senior MEP and a member of the @Europarl_EN’s #Brexit Steering Group
Firstly their broad views on the #ToryLeadershipContest
@ph_lamberts “I see many people in denial of reality.”

@AgataGostynska: “I think many of the contenders are actually delusional about what they can achieve. I think the reality will come to bite them soon.”

A senior EU official has told me that Mr Tusk told officials from the 27 remaining EU countries yesterday that “The only reasonable way out would be a long but flexible extension. I would call it a 'flextension'.... /2

Sources in EU institutions v clear tonight that Brexit extension to May 22 (which was first offered at the last EU summit & is back in play if TM can convince EU that her new plan can deliver the deal) is ONLY an option if the UK commits to European Elections. /1
The reason for this is simple.

If her plan doesn’t work & deal not done by 22/5 then there is a legally unavoidable cliff-edge ‘no deal’ at midnight on 22nd.

Why? Because the UK can’t remain a member if it hasn’t taken part in European Parliament elections. /2
Deadline (domestically) to commit to EP elex is 12/4 hence the emergence of that date as current deadline

So I imagine if the cross-party deal hasn’t been done by Mon/Tue she’ll need to commit, protectively, to EP elex & pass legislation for it. /3

NEW: EU sources insist that rules that mean smoked kipper producers in the Isle of Man must use "plastic ice pillow" when sending to UK, as made famous by Boris Johnson, are BRITISH rules and not Brussels' rules. 1/
This is a national competence. The EU does not regulate sales of smoked fish to consumer, only sale of fish from business to business. The Isle of Man example is outside scope of EU food safety rules.

I am told smoked kippers to individual customers through the post is "entirely a UK" matter.

I see this grotesque slander by #BorisJohnson is doing the rounds again. A tirade so easy to counter I am delighted to do so. Let’s call it Lessons from Liverpool, shall we 1.
He put his name to the piece so it’s his. Unless Simon Heffer had a gun to his head it is all his.
For those who may not know, Ken Bigley was a civil engineer from Liverpool who was held by the Tawhid and Jihad ("Oneness of God and Jihad") Islamic extremist group, along with two American Colleagues.

#BorisJohnson has been accused of lying about claims concerning #Turkey during the #Referendum. My legal team and I are prosecuting @BorisJohnson for the alleged offence of misconduct in public office, in connection with claims he made that the UK 'sends' £350 million to the EU.
2. Mr Johnson is innocent unless proven guilty by a court of law. Please do not comment upon Mr Johnson's innocence or guilt once the case has been initiated with the courts in the coming weeks.
3. Please use respectful and measured language when referring to Mr Johnson, the courts and our case whilst the prosecution case is active. Do not risk being accused of contempt of court.
