How do I know? I was doing employment law when this first became a practice.
The person who is hired with the H1 visa virtually never fits the “unicorn” requisition either. That’s by design. The requisition is designed to make it impossible to hire to. No one checks after the H1 is issued to see if the person they hired was truly that unicorn.
And the reason our lobbyist-reply-guy can truthfully claim “H1 is our clients last choice of options”? The law REQUIRES it to be your last choice. You can’t qualify for the visa status unless all other options are exhausted.
