Steve Double claims that it's perfectly normal to prorogue Parliament, and that it's a legitimate action.

May be technically true, but:
A) Timing is very, very far from normal
B) Length of prorogation is very, very far from normal

Zero acknowledgement that's the case!

The hardest thing to understand about the no deal headbangers is that they're going to have to keep on living in the hell they create. Like defecating in one's bed before snuggling down under the duvet. Of course their wealth & privilege will insulate them *to an extent*.
They can probably weather higher food prices, for instance. But if genuine shortages hit, what are they going to do? Will there be secret convoys of food and medicine going to MPs and their families?
It will be the most bitter of ironies if they discover we really are "all in it together" only after it's too late...

Roddy Dunlop rises for the respondent, the Crown. Begins that prorogation is done by the sovereign alone - & so is not reviewable by the courts.
Dunlop: There remain prerogative powers that are not judiciable - either as they are intensely political or sole prerogative of Her Majesty. Citing GCHQ case - there are a residue of non- judiciable cases. Pg 418: mentions disillusion of Parliament not being judicial reviewable.
Dunlop turns to ‘Smith on Judicial Review’. States proroguing Parliament is a classic example of a prerogative power held by the monarch where the courts will not interfere.

(1) I wonder if American audiences fully grasp the enormity of what #BorisJohnson has done by asking the Queen to suspend #Parliament. This is way more extreme than if #Trump asked #MitchMcConnell to delay the Senate session to avoid an unpopular vote. cnn.com/europe/live-ne…
(2) To put this #ConstitutionalCrisis in perspective, you have to remember that the #UK's parliamentary supremacy vests far more power in their legislature than we've ever given to ours. Under the American system, the Constitution is supreme. Under the UK system, Parliament is.
(3) Things have gotten trickier in recent years as #Parliament delegated some power to other institutions: regional assemblies in #Scotland and #NorthernIreland, a Supreme Court (Lords use to be the highest court), and made other structural changes. see: talkingpoliticspodcast.com/blog/2019/168-…

Last night in the ITV leadership debate Hunt ruled out proroguing Parliament but Johnson refused to.

2/. He suggests it would be inconceivable the Queen would refuse such a request but the PM’s advice to the Queen IS subject to challenge.

In fact I think a “bad faith” decision to prorogue Parliament in order to frustrate Parliamentary Sovereignty IS subject to challenge.
3/. “The Speaker, John Bercow, has stated that he will not permit Parliament to be prorogued in such a way. Prorogation, however, is within the gift of the Monarch, not the Speaker.”
