Coming up at 2PM ET the House Judiciary Committee convenes to discuss a trio of gun bills. I will have the report for @CourthouseNews. If you want to watch it live, link here:
The bills up for consideration were holdovers from before recess but with mass shootings continuing in the U.S. unabated, fervor to pass legislation is equally steady.
Up for mark-up today:
HR 1186 or the Keep Americans Safe Act. If passed, it would regulate large capacity ammunition feeding devices, like magazines or belts, thereby making it illegal to own, import or sell them.
HR 2708 or the Disarm Hate Act. It proposes banning those convicted of a misdemeanor from obtaining a firearm.

And then we come to H.R. 1236, the Extreme Risk Protection Order Act. It provides grants for state, tribal & local communities to remove firearms from individuals determined to be a danger to themselves or others (aka "red flag" provisions)
.

Chairman Nadler has proposed an amendment to HR 1236 or the Extreme Risk Protection Order Act. It specifies several parameters. To start, this is the thrust of the amendment:
Proposed method for handling of removed firearms:
General terms on order of surrender upon being served with ERPO or flagged as potential ERPO receipient. Today's hearing should flesh this out.
Assurances of due process throughout the amendment:
Before someone is hit with a red flag, according to amendment, there are certain standards that must be met.
The factors that are considered before red flagging:
Additional factors proposed under Nadler's amendment. (continued from earlier tweet where it was cut off)
On timelines and who must receive updates when ERPO is issued:
Now, standards for oversight of the proposed amendment. If passed:
Annual report to congress is mandatory, report must include: # of orders filed, # denied, # of long term orders requested, info on fraudulent petitions for orders filed (A can of worms in and of itself) etc.
Among all the petitions, orders, reports and databases, your confidentiality is a priority too - "except where necessary to enforce this Act."
