Bijan Rafiekian, Mike Flynn's former biz partner, has been acquitted.
Judge Trenga rules "no substantial evidence" existed proving Kian agreed to operate "subject to the direction and control of the Turkish government."

@CourthouseNews Per the order- a new trial is warranted on ground that the jury was not adequately instructed re: admitted hearsay stmts or the role of Michael Flynn, nor were they given proper instruction re: elements nec. to convict on foreign agent charges.
Trenga notes: when Kian made the comment, "A promise made is a promise kept" re: Flynn op-ed published in The Hill in Nov. 2016 targeting Gulen, that was not sufficient proof that the op-ed was requested by Turkey or through Alptekin.

The statute does not contend that the subject of the complaint be an employee within the intelligence community but Schiff says Maguire adopts a position that says Trump is above director, above IG, therefore, IG cant investigate. That was the IG's reading. Is that his reading?
The allegation, Maguire says, has to relate to intelligence.
Schiff, I'm trying to get to whether POTUS is beyond reach of law.
Maguire: No one is.
Schiff: yet IG has said he cannot look into it further because it involves the president and his beyond his jurisdiction
Maguire: we were waiting for exec priv to be determined. Not sure what can be done now. If I didn't send it forward within 7 days, then the statute would allow whistleblower to come to you and still be protected.

Judge:

The Gov't "failed to offer substantial evidence" that Rafiekian acted as an agent of a foreign gov't.

"There is no substantial evidence" that he agreed to cooperate subject to the direction/control of Turkey; no evidence of any implied agreement w/ Turkey.
On the Flynn Intel Group FARA filing:

"There is no evidence of discussions or suggestions, let alone an agreement, express or implied, to either avoid filing under FARA or to cause the filing of a false FARA registration statement."
