Breaking: U.S. District Judge André Birotte Jr. has issued a permanent injunction barring ICE from asking police to detain immigrants based on info in scattered federal databases, saying the practice violates the 4th Amendment. Read the 37-pg order here:

Judge Birotte wrote in the ruling that ICE cannot issue detainers in states that don’t "expressly authorize civil immigration arrests in state statute," thereby invalidating ICE detainer requests in CA.
These detainers allow local and state police to hold people for up to 48 hours past their scheduled release date. During this time, @ICEgov scans multiple federal databases for matching biometric info to determine an individuals' legal status and whether to order deportation.
@ICEgov ICE issued an immigration detainer on the lead plaintiff in this class action lawsuit - Gerardo Gonzalez, a U.S. citizen born in Pacoima, a neighborhood in Los Angeles - even though an ICE agent had never interviewed him.

More Flores settlement news: Flores counsel asked a judge Friday to order the govt to release migrant children detained at the for-profit Homestead facility in FL within 14 days of placement. 2020 Dem candidates visited Homestead this week. Motion: bit.ly/2Ylce9h
“At Homestead, children are housed in prison-like conditions & unnecessarily incarcerated for up to several months w/o being determined to be flight risks" or dangerous, the motion said, adding that release is being delayed until kids are deported, sent to a sponsor or turn 18.
The population at Homestead has grown from 423 children in April 2018 to 3,728 children in May 2019. The avg stay is 67 days, motion says, well over what is defined in the Flores settlement, which governs treatment of detained migrant youth.

Breaking #ICE news: After holding a trial, federal judge in Los Angeles rules that ICE cannot rely on patchwork of federal databases to detain people held in state and local custody, invalidating the single biggest method that ICE uses to detain people across the country.
Judge also rules that ICE cannot issue so-called "detainers" - requests to state/local jailers to hold people for ICE to pick up - in states that don't explicitly authorize their employees to cooperate with ICE. That means detainers are invalid in states like CA and NY.

2. Judge Furman is allowing an attorney who has left DOJ (Brett Shumate) and an attorney who has left DOJ's Civil Division (Alice LaCour) to withdraw from #CitizenshipQuestion lawsuits in NY.
3. But Judge Furman says every other DOJ attorney who wants to withdraw from #CitizenshipQuestion cases in NY has to submit signed & sworn affidavit that:

- provides "satisfactory reasons" for leaving at this stage of litigation
- confirms they'll comply with sanctions motions

BROWNSVILLE, Texas –The son of the former Gulf Cartel leader has been ordered to federal prison following his conviction of illegally possessing a firearm & impersonating a U.S. Marshal, announced U.S. Attorney Ryan K. Patrick. Osiel Cardenas Jr., 26, pleaded guilty May 22, 2018.
Today, U.S. District Judge Fernando Rodriguez Jr., handed Cardenas a 27-month sentence to be immediately followed by three years of supervised release. The court also ordered Cardenas to pay a $15,000 fine.
