Breaking: U.S. District Judge André Birotte Jr. has issued a permanent injunction barring ICE from asking police to detain immigrants based on info in scattered federal databases, saying the practice violates the 4th Amendment. Read the 37-pg order here:

Judge Birotte wrote in the ruling that ICE cannot issue detainers in states that don’t "expressly authorize civil immigration arrests in state statute," thereby invalidating ICE detainer requests in CA.
These detainers allow local and state police to hold people for up to 48 hours past their scheduled release date. During this time, @ICEgov scans multiple federal databases for matching biometric info to determine an individuals' legal status and whether to order deportation.
@ICEgov ICE issued an immigration detainer on the lead plaintiff in this class action lawsuit - Gerardo Gonzalez, a U.S. citizen born in Pacoima, a neighborhood in Los Angeles - even though an ICE agent had never interviewed him.
