I missed the "just kidding" defense in law school.
They didn't teach us about the "do the thing you're accused of doing in private right out in the open" affirmative defense to anything illegal in law school either.
And I literally can't believe no one in all these years of practice didn't tell me that simply by saying something that was plainly illegal was not actually illegal at all and totally fine would make it so.
At least I now know that "hearsay" is no longer a thing that can be used against my clients. See below for a non-exhaustive list of everything that the government will now have to stop doing. Added bonus: The GOP just ended mass incarceration!
But here's my question. Since Giuliani seems now to believe that we should ignore his commission of even the most serious of felony offenses, can he help expunge the records of the hundreds of thousands of Black & Latinx people he overpoliced in the 90s for low-level offenses?
Another question: Since Barr now thinks that serious felonies shouldn't be investigated, can he help work to undo the horrors of pretrial detention, mandatory minimums, parole, & overcriminalization he designed & implemented as the chief architect of mass incarceration in 1990s?
I'll end with this. It is remarkable but not surprising that Trump & his "Law & Order" colleagues are selective abolitionists. Yet some of the critiques of the system are actually valid. I wrote about some of the truth's in their law enforcement hypocrisy:nytimes.com/2018/09/19/opi…
