A key question for #DataProtection watchers in Ireland today is: “How much did @DPCIreland actually get? (And how much did they look for?)”

We have had nearly 5 years of appreciable upping of DPC budget from €1.5M in 2014 to the present €15.2M. 1/n
2/n But the office is still under manned and regularly outgunned even though it is de facto regulator for much of world’s personal data. Also, comparing to the Financial Regulator pre-crash, @DPCIreland is still less than 30% the resource levels that were keeping an eye on banks
3/n However, @DPCIreland has picked a huge fight (rightly) with @IRLDeptPER over #MyGovId. But @IRLDeptPER allocates the budgets to public bodies. So, there is a HUGE risk of the independence of the Office being attacked by pulling in the purse strings.
4/n This is also a risk for DPOs in Public and Private sector (arguments with management that are settled by cutting budgets), but difference here is there is established CJEU case law on things that compromise the independence of a Regulator (GDPR does have some DPO protections)
5/n So, the key question to be asked and answered today by @IRLDeptPER is threefold:
1) How much did you give @DPCIreland ?
2) How much did the Office actually ask for?
3) Explain the rationale for the gap?
6/6 The optics of a Regulator who will be getting busier post Brexit, who is already recognised as being under resourced, getting significantly less than asked for in a Budget after taking action against a flagship project of the Dept for Budgets aren’t good internationally.
7/6 This is particularly relevant when @DPCIreland is facing into potentially expensive legal battles with @welfare_ie, @IRLDeptPER, @DCYAPress, @facebook, @twitter and others. Particularly the former. Because that’s how the State muzzles a Regulator who was starting to bite.
8/6 So journalists, those key questions again are:
1) How much exactly did @DPCIreland get?
2) How much did @DPCIreland ask for?
3) What is @IRLDeptPER rationale for the gap?
9/6 And @EU_Commission, @VeraJourova, and @SophieintVeld it might be worth asking @IRLDeptPER how much budget they have given the Regulator who has found their strategy for the roll out of #MyGovID/#PSC to be unlawful.
