Thread: (1) New #asylum legislation will be voted tomorrow in the Greek parliament. Here are some points you might find useful to know regarding the process as well the content of the new law. #refugee
(2) All major national and international organisations have already criticised the gov for allowing only 5 days of public consultation as an effort to avoid scrutiny and warned the new law is leading to a backlash on human rights.
(3) The law introduces a series of measures aiming to restrict access, reduce times or terminate the asylum procedure. It also aims to expedite+increase the amount of people returned. The basis of this strategy is the re-introduction of en mass long term detention.
(4) Including detention of asylum applicants. Appealing the 1st instance decision will require technical legal documentation, effectively meaning being able to afford a lawyer. Up to now a simple request was enough.
(5) This way the gov expects to reduce appeals and accentuate deportations. UNHCR is cut out of the second instance (appeal) committees. These will consist only of administrative judges.
(6) It predicts the introduction of a list of safe third countries, a measure likely to lead to less cases offered an individual assessment, which would contravene the Asylum Procedures Directive and international law.
(7) Vulnerable persons will not be excluded by border procedures (fast track profile evaluations prior to hearing a request in its essence), if offered adequate support (an unclear provision). PTSD wont be a valid qualifier for vulnerability status.
(8) Introduces punitive measures. For example those denying their transfer to an assigned accommodation could lose access to the asylum procedure and be eligible for return.
(9) Another example. Violation of accommodation rules immediately leads to expulsion from it. Its unclear how this measure will be implemented since authorities in most camps do not implement any internal rules anyway.
(10) A day before new law was presented the EC has asked EUParliament to adopt targeted amendments on AMIF and ISF that will facilitate a new budget line to finance the new status quo as illustrated by the forthcoming new asylum legislation.
