Happening now: Mr. Robert Opio, 58 years, resident of Mukono Municipal Council, Ag. Commissioner Land Registration, on the witness stand, to testify on subject land comprised in Busiro Block 534-540 Plot 326, Land at Buwaya which was sold to Uganda Free Zones Authority. 
He says that the office of the Commissioner Land Registration refused to transfer the land to UFZA. That there was a complaint made on 7th June 2018 from Katende Sempebwa & Company Advocates which culminated in a report authored by Kabira Aisha, Senior Registrar of Titles.
Ms. Kabira's assessment report was that the land was issued to George Nyanga, and so could not be titled again for Alexander Ndiwalana Gabunga. That the reconstruction should have been in the names of Nyanga and not Gabunga if there was a valid claim.
Ms. Kabira's observation was that there was no evidence that Galiwango was a descendant of Gabunga. The title had no roots and the adjudication process was not properly carried out. That the title issued to Lutaya and Bukenya couldn't stand.
The title could not stand because it was over land not belonging to them. That the 2nd title had problems in the way it was created, she recommended that the titles be canceled. That the Commissioner would take steps to caveat the land to protect the interests of the Government.
Mr. Opio says that when Ms. Kabira's report got to his attention, he asked for a public hearing before Katwesigye Christine. The outcome of the process was that submissions were made where Sempebwa and company advocates insisted their client was a bonafide owner of the land.
Commission: Sempebwa appeared before the Commission last week and he said they have done a search and their title is still in place.

Mr. Opio: The Attorney General has advised that the money given to Dick Lutaya and Paul Bukenya should be recovered. The search was made to the wrong office. What ought to have come out was an investigative report as to why there were discrepancies and not a search letter.

Mr. Opio proposes a system where all the concerned parties in land registration have a central system, like the surveyors, where there is accountability. He suggested professional indemnity insurance, just like that of lawyers in some countries.
Mr. Opio informed that the cancellation of the land title is not only in question regarding the ownership because it encroaches on the Kironde family estate but also encroaches into wetlands and forests- Nkanga forest and wetland.
