Back to my campaign against judicial supremacy . . . have you noticed that the Founders did not put the Supreme Court in charge of impeachment, or as the final say on impeachment?
Yes, I know the Chief Justice presides over the Senate trial. But the Founders in no way thought the Supreme Court should have the final say on something like this.
If we were designing the impeachment system today, I have no doubt that people would think the logical thing would be for the impeachment to be tried in front of the Supreme Court.
Because we all function under the assumption that the Supreme Court is supposed to have "the final say" on things.

But they aren't, and it's clear from the Founders' design that the Founders didn't intend for them to have the final say.
