This is where we are, America. Allowing shoddy, junk-science to send people to death row and, regularly, to their executions.

To allow any execution to go forward in 2020 — in light of all we know — is to affirm that you believe this system, clearly broken, is working.
To be clear, the sentence in Bryan’s case was not death. But many death sentences rest on such junk-science testimony. And for Bryan, it has meant, effectively, life in prison:
“... nine of those defendants had been executed ...”

Majority opinion here by the former Becket Fund lawyer who also litigated to defend marriage bans, now-5th Circuit Judge Kyle Duncan, who everyone knew was anti-trans when he was nominated and now he's an appellate judge for life writing these sorts of opinions.

In "it's a small [and awful] world" news, Judge Smith, who joins Duncan's majority opinion today, was on the panel that heard the marriage cases back in 2014, where Duncan argued to uphold Louisiana's ban. Smith was the one judge who seemed to side with Duncan at arguments.
