Today, 10.1.2019, the Supreme Court holds its long conference, an annual meeting where they will decide which cases they want to hear this year.

All it takes is 4 justices to OK a case for them to hear it.

One case in particular has the power to dismantle #Roe.

Franchise Tax Board v Hyatt is the sleeper abortion case you have not heard about. Because, of course, it is not about #abortion.

But the decision - and HOW it is reached - is going to determine how the incoming wave of abortion cases are going to be resolved.

The FTB case came from a tax dispute. A former resident of California sued the California Franchise Tax Board in a Nevada state court, claiming that it had done him all manner of wrongs in investigating his purported tax liability.

California does not want to be sued in another state’s courts. The current law, decades old, allows such suits.

The case has nothing to do with abortion, but everything to do with how to overturn precedent.

Supreme Court ruled on two cases related to abortion on the same day. Many people recognize the landmark case Roe v. Wade, a case originating in Texas. In January of 1973, the Supreme Court issued its decision in Roe v. Wade, and the same day on a companion case, Doe v. Bolton.

A few weeks before Kavanaugh's name appeared on President Trump's short list for a new justice, Kavanaugh praised the dissent in the Roe v. Wade case and called former Supreme Court Chief Justice William Rehnquist his “hero,” noting that “he clearly wanted to overrule Roe.”
As a federal judge, Kavanaugh tried to prevent a young undocumented woman in government custody from exercising her right to an abortion.

Last night I promised a thread about #abortion before Roe v Wade legalized it nationally. Until the mid-1800s, common law allowed abortion until "quickening", when fetal movement can be felt. Toxic abortion remedies & doctors competing w midwives led to… 1/
