The #DNCFraudLawsuit is a case that we filed in June of 2016, on behalf of a number of named plaintiffs + proposed classes of Bernie Sanders donors and donors to the DNC + members of the Democratic Party, seeking relief on the basis that the DNC failed to follow its own charter,
in the conduct of the Democratic presidential nominating process + we're seeking relief in the form of damages, essentially the return of donations that people paid to the Bernie Sanders campaign
under the belief and understanding that this was a democratic, free and fair election process that they were participating in through their donations to the Bernie Sanders campaign.
The class is defined to include everyone that donated to the campaign, we're talking about 220M $$$ + in donations, so we're talking about a very significant damage calculation on a class-wide basis.
"Democracy demands the truth, so that people can make informed decisions"
Three of the original 120 named plaintiffs were national Sanders delegates, who were dropped from the caption after they were threatened with de-credentialing, which would have made them ineligible to attend the Democratic National Convention + cast their votes for Sanders -
unless they ceased participating in the lawsuit.
The Complaint was brought in the names of 120 representative plaintiffs -- (our lead or "first-named" plaintiff, Carol Wilding also just happened to live in Broward County),
and against the DNC and its chair, and alleged claims for fraud, negligent misrepresentation, statutory unlawful trade practices, unjust enrichment, breach of fiduciary duty, and negligence.
The Compliant alleges these claims on behalf of thee distinct proposed classes: (1) donors to the Sanders campaign; (2) donors to the DNC; and (3) members of the Democratic Party. The first five claims pertain to the DNC's failure to live up to the obligation of neutrality.
The sixth claim, for negligence, concerns the DNC's failure to safeguard the data of its own donors (among the items published by Guccifer 2.0 were spreadsheets containing the private information of donors).
More regarding the case as time permits.
