Trump's lawyers keep arguing that an adequate case is the same thing as a full, fair case. That's wrong. Imagine a business fraud case where the evidence consisted of (a) a solid but complex forensic accounting, + (b) a former bookkeeper who was instructed to cook the books.

Now imagine the court allowed the forensic accounting report, but excluded the bookkeeper's testimony.

Are the accounting docs enough to warrant a verdict? Sure. But is the case even stronger if the jury hears the percipient witness explain it directly? Of course!

So it's NOT inconsistent for the impeachment managers to argue that (a) they've presented an adequate case, and (b) they nevertheless should be allowed to present their BEST case.

I've been a litigator/trial lawyer/arbitrator for nearly 33 years. I've represented clients I didn't like very much, and I've represented clients who were at least partially wrong.

But I've never done what Philbin + Cipollone are doing.

I've never lied for a client. I've never made an argument I knew to be legally spurious.

When my client was wrong, I've found the places where my client was RIGHT, + argued those.

E.g.: "Ladies + gents of the jury, my client caused the accident. He's liable! BUT the plaintiff was speeding, too, + he's overstating his injuries. So my client is liable – but I ask you to be fair when you award damages."

It can be VERY effective, bec it's based on truth.

The first successful impeachment was in 1803, of John Pickering, a judge appointed by Pres. Washington.

A Congress CONSISTING OF FOUNDING FATHERS impeached him for "wickedness" "loose morals and intemperate habits" (ie, drunkenness).

WHICH ARE NOT CRIMES.

BUT HE WAS CONVICTED.
Which is my way of saying: fuck you, @AlanDersh. You KNOW this history. Stop lying about it.
FWIW, the Pickering affair was an embarrassment all around. The poor judge was having MH problems, and Jefferson (a terrible president) was being absurdly partisan. But Pickering's case makes it historically impossible to say the Framers contemplated impeachment only for crimes.

Welcome to today's #Trump #ImpeachmentTrial thread (potentially one of a few)! I've been playing around with tags a little in other tweets this morning but for now, I'm going to stick with the two I've used here. That may change later on, though. Follow/mute at will!
Today is going to be procedural stuff. The Senate will have to approve the (completely BS) rules proposed by McConnell. Dems will offer amendments, of course, but since a simple majority rules I don't have a lot of hope any of the amendments will pass. #Trump #ImpeachmentTrial
For those of you just tuning in, McConnell is proposing that this trial have:

Zero witnesses
Zero admitted evidence
Ridiculously little time set aside for opening arguments and questions.
As little sunlight as possible.

A note on #impeachment -

In a court of law, under non-presidential circumstances, impeachment is a tool litigation attorneys use to discredit the opposing side's witnesses at trial. When said witness takes the stand under oath attys. present evidence contrary to what the witness
claims. This weakens the other side's case by discrediting impeached witnesses's testimony. Once a witness has been impeached - by presentment of inconsistent testimony - the judge/jury can no longer use the impeached witnesses's testimony in reaching a verdict.
Simply put, they aren't trustworthy. In the case of Presidential impeachment that broad definition of impeachment applies, but the impeachment tool is used for a very different purpose. Under the Constitution, a sitting President cannot be tried in a court of law for anything.
