NEW: The top intelligence community lawyer, whose move to block a whistleblower complaint from reaching Congress led the House to embrace impeachment, is resigning.

Here's Klitenic's Sept. 13 letter to Schiff, indicating that the agency would overrule its inspector general's effort to provide the whistleblower complaint to Congress.

Within two weeks of this decision, Pelosi had embraced an impeachment inquiry.

BREAKING: The House has won the Appeals Court case seeking access to Mueller's grand jury information. A 2-1 decision, with RAO dissenting.
In the majority opinion, the courts describe affording reat deference to the House because of its "sole power" to conduct impeachment proceedings as it sees fit.
The majority opinion also says Mueller's report, on its face, made no conclusions about Trump's conduct "in part to avoid preempting the House's sole power of impeachment."

GAETZ, per the White House pool, was just on Air Force One with Trump.
Presumably Gaetz just learned about his possible exposure hours ago, but per his office was already able to get tested. We haven't heard much about availability of tests for lawmakers and aides:

JUST IN: The Judiciary Committee is seeking a rehearing of the McGahn case, saying an earlier Appeals Court ruling left the House with only extreme options to get info from the WH — such as arresting high-level officials.
The House also reiterated (for the first time post-impeachment) that it could consider new articles, perhaps for criminal obstruction of justice, if McGahn's testimony supports it.
NEW: The House Judiciary Committee says the ruling denying its effort to obtain MCGAHN's tesitmony would eviscerate congressional oversight of the president.

1. Democrats' Best Laid Plan for Impeachment Has Blown Up Spectacularly

Allow me to paint a picture of my speculation on what seems to have happened and will likely happen.
2. This was a 'spy thriller' of a plan. Get a deep state spook to compile a complaint dossier, of course with the help of lawyers to ensure it passes muster with the IG as an "urgent matter." That way, the planners thought it would have to be rushed to Congressional committees.
3. Except the Acting DNI Maguire quite appropriately sought help from OLC (Office of Legal Counsel) to ensure he had the authority to release it to Congress without a waiver of executive privilege from the President.

Congress & White House have a history of fighting abt what classified material Congress can have on demand. In this case, a fed’l law says that a #whistleblower complaint that the Inspector Gen’l finds “urgent” be sent to Congress Intel Committees. So what is “urgent”?
The federal law defines “urgent” as “A serious or flagrant problem, abuse, violation of law or Executive order,..., or operations of an intelligence activity involving #classified information...” among other things. This appears to be the relevant part of the #whistleblower story
Congress states “Congress as a co-equal branch of Gov’t, is empowered by the Constitution to serve as a check on the executive...it has a ‘need to know’ of allegations of wrongdoing...including allegations of wrongdoing in the Intelligence Community.” bit.ly/32RviOp
