An interesting case:

In 1984, 2 public servants were arrested & charged with sedition for raising the slogan “Khalistan Zindabad”.

In that case (Balwant Singh & Anr v/s State of Punjab), the SC ruled that mere stray chanting of any slogan can NOT constitute sedition.

The SC bench, comprising Justice AS Anand & Justice Faizan Uddin had said:

“Police officials exhibited lack of maturity and more of sensitivity in arresting them for raising the slogans and this could have created a law and order situation in the already tense situation”

Amulya’s act was stupid (possibly even a publicity stunt).

Stupidity is NOT sedition. If that weren’t the case, we wouldn’t have enough prisons to keep people.

Sedition law must go. Meanwhile all states not abiding with the SC’s guidelines on sedition must be pulled up.

PS: By the “logic” of Bangalore Police, Indian cricketers who stand up for the Pakistani national anthem before a match are committing “sedition”.

That’s how dumb all of this is - & a matter of shame that cops don’t know the basics of law (and bend for their political masters)
