The judgment and press summary are super defensive! The court has gone to pains, no doubt in the context of the government's threat to water down Judicial Review, to say that this isn't about politics it's about law
Also, this little nugget at the end in case government 'sources' say how this is just another example of the courts exceeding their authority. If you don't like the judgment, why didn't you appeal?
I'm not an environmental lawyer but fascinating to see the power of Paris Agreement to constrain government action on key infrastructure decisions. Though since it only needs to be 'taken into account' (and wasn't in this case so unlawful decision) maybe it isn't much of a power
A guess here, and I haven't read the whole judgment, but it may be that the reason the govt isn't appealing is that a further decision will swiftly be made 'taking into account' Paris Agreement - this could be seen as a pretty technical victory and same result may well follow
By technical victory I mean that this seems like the cases where the government fails to carry out an equality impact assessment as required by the Equally Act, but then goes back and carries one out, makes the same decision and it is lawful as it has wide discretion
It has been pointed out to me by @ShoaibMKhan that Boris opposed the 3rd runway so it may be that the reason this isn't being appealed is that the decision will be reversed but this gives a nice way out (blame the courts!)
