1/3 The President's lawyer apparently argues that a president cannot obstruct justice. That is quite simply wrong as a matter of law, as @NormEisen, @BarryBerke, & I explained in great detail. brookings.edu/wp-content/upl…
2/3 Whether a president can be prosecuted criminally while in office is an open question, as we acknowledge. We argue that he likely can be, but that is not fully resolved.
3/3 But there is no real question that a president can be guilty of obstruction of justice & can face consequences for it. In fact, obstruction of justice was a basis for articles of impeachment against both Presidents Nixon & Clinton.
