The state Tax Department has the authority to investigate whether anyone violated state laws criminally. They then refer the findings to the appropriate law enforcement agency [usually the DA, sometimes the NY AG] to present to a grand jury.

Cuomo has been criticized for not issuing a criminal referral to the NY AG, who already filed a civil suit against Trump's Foundation. But the AG fears a referral at this point would delay the civil suit and its efforts to hold Trump's Foundation & directors accountable.
