This is a very important piece in the Carter Page #FISA documents put together yesterday evening by @DavidKris. You should read it.
One note on Kris’s first point, that the disclosure of a FISA application is alone monumental, even if redacted heavily, as this one is:
Back in the mid-1990s, as a young reporter for Legal Times, I wrote a long piece on the FISA Court and process, about which almost nothing substantial had previously been written.
At the time, the Justice Department was EXTREMELY cooperative with my reporting, as was the court itself. One thing we discussed their producing but which they decided they could not, however, was a mere TEMPLATE for a FISA application.
That is, even scrubbed of ANY evidence, ANY target information, and ANY source information, even scrubbed of any relation to any case, the mere structure and form of a FISA application was to sensitive to disclose.
More than twenty years later, this actually the first time—to my knowledge anyway—that it has happened.
So if anything, @DavidKris is understating the matter when he says this:
One other thing: @DavidKris knows more about FISA, both academically and operationally, than anyone else who speaks in the public arena. Your periodic reminder that if you are at all interested in dispassionate, high-quality information on these matters, #youshouldfollow him.
