1/ Update in Obamacare litigation. In November, I predicted the Democratic-controlled House would retain Don Verrilli to defend ACA.
2/ Tonight--after California filed its notice of appeal--Don filed his notice of appearance on behalf of the House. Once again he will have the responsibility of defending Obamacare. What did I say? Groundhog Day.

2/ J. O'Connor reiterates a point I made on @VolokhC - the standing inquiry is separate from the merits inquiry. The legal command still exists on the Plaintiffs in Section 5000A(a), and it is still binding. (With a citation to @RandyEBarnett) reason.com/volokh/2018/12…
3/ J. O'Connor explains, at great length, why "Written law is binding, with or without the specter of an enforcement provision." If you agree with this first principle, then it naturally follows that the mandate still has legal force.

Oral arguments getting underway shortly for Adnan Syed's hearing at MD Court of Appeals. His attys will ask for retrial because of the ineffective counsel they say he rec'd when he was on trial for allegedly killing HS gf Hae Min Lee in 1999.
Syed claims his trial attorney, the now-deceased Cristina Gutierrez,failed to call a key alibi witness for testimony: Asia McClain – who now goes by Asia McClain Chapman. She could have corroborated his alibi because she would have testified that she saw Syed at a local library..
..during the time prosecutors say Lee was murdered. The State of MD argues that the U.S. Constitution does not require attorneys to pursue every possible alibi presented to them.

Save the date: November 8, when my wife's pension appeal against NJ is scheduled to continue, with the state's doctors to tesify. We have long suspected the state is deliberately stalling because they know it is highly likely the administrative law judge will favor my wife.
Yeah I know New Jersey's pension system is crying broke, but that's not my wife's problem. She didn't ask to be assaulted and severely injured by a student while teaching high school in 2006. This is a problem of the state's making.
For two decades, administrations both D and R failed the contribute the state's share to pension funds while public employees have contributed. Let the stock market take care of pension funds, they thought. Then came the 2008 meltdown.

Public pension funds in #NJ and #OH used **HUNDREDS OF MILLIONS OF DOLLARS of taxpayer money** to bankroll a failing business: #AMI, the company that owns The National Enquirer.

Chatham & another Chatham co. manage **$500 million of #NJ state pension funds & $125 million of #OH state pension funds** and are raising new money/trying to refinance **$450 million in AMI debt**. Only w/Chatham’s support did Pecker keep control of AMI.

I did something similar to this 5 years ago, in anticipation of EC & @theroots' Wise Up Ghost LP, on tumblr.

(You can still find all those posts if you look, although a lot of the YouTube links etc are now dead ends. It was 40 Days Of EC then, so for 2018 I'm upping it to 45.)
Mostly I will be going chronologically from the early years right up to the present, but it feels right to start out with Costello's 2002 song, "45."
