chief brackney comin’ out hard with the passive aggression at jeff fogel’s requests for stop & frisk data
their position is that the records jeff has requested are exempt from FOIA as criminal investigation files. even though the vast majority of stop & frisks result in no actual criminal charges of any kind.
further, the records he has requested “do not exist in the FORMAT” he requested them.
she says there are “data extraction challenges” but would be willing to work with jeff fogel if he is willing to pay for the costs of collecting the data.

henry graff asks chief brackney if she sees any problem with the stop & frisk numbers. she evades it. she says she can’t say there is disproportionate minority contact, again citing her brief time on the job.
another reporter asks when she might have that done (her own analysis of the data). again, evasive. apparently they’re having software issues. someone is going to be hired to extract the data.
“it’s those discretionary encounters they we should all be concerned about,” she says. yeah... that’s what we’re talking about when we say stop & frisk. that’s literally what we’ve been asking about.
she says the information requested (race, ethnicity, reason for the stop, etc) is getting LOGGED, but the software issue is affecting the ability to extract this data.
a reporter asks how many stops there are in a year. she can’t answer that. “it’s not even necessarily a number.”
(no, it is. it’s absolutely a number.)
the center for policing equity has been invited to come help. brackney says they are committed to getting “the best product” out to the people of charlottesville.
(product? is policing a product? it isn’t even a SERVICE, let alone a product)
graff asks if brackney can at least sympathize a little bit with jeff’s concerns. she has yet to answer a direct question with an actual direct answer. no change this time.
jeff fogel: “i would like to straighten out some of the factual material presented here.”
jeff says he has five years of data that contains all the information he asked for. in july he was told the info is no longer available in that format. he says he doesn’t care about the format — just give him the info. he says they stopped responding after that.
brackney keeps trying to cut him off.
jeff: 70-80% of people stopped are black. only 12% of those stops show the person was engaged in any criminal activity. white people stopped were twice as likely to be engaged in criminal activity.
“I WILL NOT YELL. I WILL NOT YELL,” brackney says loudly, over jeff’s continuing remarks.
charlottesville police chief brackney: “we do not do stop and frisk. we don’t.” “i will not label what we do based on some national trends.”
“here we do warrantless search and seizures.”
chief brackney, what exactly is the difference?
chief brackey declines to address ms katrina’s remarks. she wants to know why brackney has accused her of lying about her still-open complaint against the department.
harold folley from LAJC asks how soon this new data might be available.
brackney: there is a part time temporary employee who is working in this exclusively.
it’ll be posted on the website when it’s done.
harold: what if this data is the same as the other data, what will you do?
brackney: she can’t say. refers again to the “nationally recognized experts” who are gonna come in and help.

reverend don gathers asks if there is anything that can be done in the meantime to get ANY data out? brackney says the old software system (pistol) is gone. they can’t use it to pull new data.
(this is a piss poor location for a press conference. there is a bus stop nearby. the traffic sounds and lack of sound equipment make it really difficult to hear. is she afraid to face the public without the entire system literally behind her?)
