I'm so embarrassed.
Honestly, though, it's so 2018 for questions about whether the acting AG is legit or not to come down to how people read a case from the late 1800s about people fighting over expense reports.
"The petty item for lights upon the King's birthday was approved by the Department of State, and appears to be a charge within the discretion of that department. It is therefore allowed."

#SCOTUS, Jan. 8, 2019. With most of the sights in DC shut down, the Supreme Court is drawing a big crowd even for relatively low-profile cases.
It's a one-box Tuesday here at #SCOTUS, meaning one or two decisions in argued cases should be coming at 10a.
The first decision is Justice Kavanaugh's first majority opinion, in Henry Schein, Inc. v Archer & White Sales, Inc., vacating the 5th Circuit in an arbitration case. The decision was unanimous. #SCOTUS

In the mid-1800s, Senators from Vermont & Massachusetts introduced legislation to expand the Supreme Court to 15 Justices, but only 7 would be randomly selected to sit in Washington to adjudicate Supreme Court cases; the rest would ride circuit, sitting primarily as trial judges
It was a stupid idea and the Senate decisively rejected the proposal, but from what I've seen no one suggested it risked creating a "constitutional crisis" as either side almost certainly would declare today, if the other advanced the notion.
Throughout much of the 19th century, appeals from federal district courts were to circuit courts, staffed by a single judge, who often was the same district judge who issued the ruling under appeal! Circuit court appeals often wound up being more like motions for reconsideration

Court: They charged your client with conspiring to defraud the FEC

Defense: "If they haven't delineated that in the indictment, how do we know what we are charged with, and what did the grand jury actually indict us with doing?"
