Key to all this is the claim that without Para50 the backstop *undermines* the Good Friday Agreement, rather than supporting it. Brussels rejects this claim outright, saying the removal of EU law, which bound both sides, creates an entirely new challenge beyond the GFA
EU27 source texts: "GFA did envisage co-operation between N&S on a voluntary basis - but as common EU membership was assumed, in a context where issues of cross-border trade & common standards did not arise & were determined by EU law. Situation now goes well beyond scope of GFA"
