Update on the mystery grand jury case at #SCOTUS: Apparently the company filed a supplemental brief supporting its petition for certiorari. It has asked the court for "an order directing the Clerk to file an unredacted version" of that supplemental filing. supremecourt.gov/search.aspx?fi…
To keep everything together: I had more on the mystery case today, in this thread —>
More today in the mystery grand jury case — first spotted by @hsu_spencer: We now have a copy of the district court docket of the subpoena challenge (w/ redactions) available —> dcd.uscourts.gov/sites/dcd/file…
Notably: This past Thursday, Jan. 24, Judge Howell denied the foreign country-owned company's request that the court rule that its contempt order is unenforceable and that the company's property is immune from attachment.
Note also that at least the top government lawyer's office appears to be the same length as the special counsel's office line in Andrew Miller's grand jury dispute.
Following the 1/24 order from Howell, the company filed a supplement in the DC Circuit on its pending request. That DC Circuit request appears to remain pending, but was initially filed on 1/16, the day after Howell denied a motion to stay the accrual of fines pending [REDACTED].
In English: I think the DC Circuit filing on 1/16 by the company likely was a request to stay the accrual of fines. And then on 1/25, the company filed a supplement, responding to the 1/24 ruling from Howell. The government responded to that supplement on 1/28.
There was a per curiam — unsigned — order from the DC Circuit — sealed, of course — on Tuesday. We have no idea what it is, technically, but it doesn't appear to relate to the @rcfp request, so it could be an order on the company's 1/16 motion.
